Convention on the Rights of the Child/児童の権利に関する条約（抜粋）
Article 38
1. States Parties undertake to respect and to ensure respect for rules of international humanitarian law applicable to them in armed conflicts which are relevant to the child.
2. States Parties shall take all feasible measures to ensure that persons who have not attained the age of fifteen years do not take a direct part in hostilities.
3. States Parties shall refrain from recruiting any person who has not attained the age of fifteen years into their armed forces. In recruiting among those persons who have attained the age of fifteen years but who have not attained the age of eighteen years, States Parties shall endeavour to give priority to those who are oldest.
4. In accordance with their obligations under international humanitarian law to protect the civilian population in armed conflicts, States Parties shall take all feasible measures to ensure protection and care of children who are affected by an armed conflict.
第38条
1 締約国は、武力紛争において自国に適用される国際人道法の規定で児童に関係を有するものを尊重し及びこれらの規定の尊重を確保することを約束する。
2 締約国は、15歳未満の者が敵対行為に直接参加しないことを確保するためのすべての実行可能な措置をとる。
3 締約国は、15歳未満の者を自国の軍隊に採用することを差し控えるものとし、また、15歳以上18歳未満の者の中から採用するに当たっては、最年長者を優先させるよう努める。
4 締約国は、武力紛争において文民を保護するための国際人道法に基づく自国の義務に従い、武力紛争の影響を受ける児童の保護及び養護を確保するためのすべての実行可能な措置をとる。
Article 39
States Parties shall take all appropriate measures to promote physical and psychological recovery and social reintegration of a child victim of: any form of neglect, exploitation, or abuse; torture or any other form of cruel, inhuman or degrading treatment or punishment; or armed conflicts. Such recovery and reintegration shall take place in an environment which fosters the health, self-respect and dignity of the child.
第39条
締約国は、あらゆる形態の放置、搾取若しくは虐待、拷問若しくは他のあらゆる形態の残虐な、非人道的な若しくは品位を傷つける取扱い若しくは刑罰又は武力紛争による被害者である児童の身体的及び心理的な回復及び社会復帰を促進するためのすべての適当な措置をとる。このような回復及び復帰は、児童の健康、自尊心及び尊厳を育成する環境において行われる。
（解説）
これらの規定は、それまで別個に発展してきた国際人道法と国際人権法を融合させた画期的な規定だ。国際人権法を語るときに国際人道法の存在を無視することはできない。当然のことながら、子どもの権利を論ずるときに、国際人道法の存在を無視することはできない。
現にその権利を踏みにじられているこどもがガザに多数いながらも、何もできない己の無力さを嘆きながら。
